Why is Intellectual Property becoming so critical to small business? - Progressive Legal Regardless of size, almost every business has some form of Intellectual Property that they have to protect, whether it's trade marks, registered designs, copyright, trade secrets, patentable inventions, domain names and now even social media handles!

It's vital for small businesses to protect their IP for long term financial success and brand building, and to be more competitive than industry rivals.

We're increasingly seeing small businesses receiving cease and desist letters from larger, (even international) businesses demanding them to stop using their chosen trade marks based on a registered, superior right. It's really quite scary what we are seeing.

In this scenario, their options may be:

1. Engaging in potentially expensive and time consuming defensive dispute resolution (possibly Court litigation);

2. Substantially re-jigging their business’ branding; or even worse

3. Abandoning their brand entirely and starting from scratch!

Even the thought of having to rebrand makes me shiver!

The problem we're seeing is that businesses big and small are going after smaller businesses.
